On April 27, 2020, the website of the Arbitration Court of the city of St. Petersburg and the Leningrad Region published information on the registration of the application of LLC Pervy restoran regarding the recognition of TD “BALTIISKIY BEREG” LLC bankrupt (case No. A56-33478 / 2020) in connection with the alleged debt .
The request of LLC “First Restaurant” was filed in violation of the Arbitration Procedure Code of the Russian Federation, Federal Law of October 26, 2002 No. 127-ÔÇ On Insolvency (Bankruptcy).
We hereby inform you that there are no grounds for declaring the TD “BALTIISKIY BEREG” LLC bankrupt: there is no DUTY and a court enforceable judgment that has entered into legal force.
LLC Trading House BALTIC COAST has written evidence, including consignment notes confirming the absence of DEBT. The evidence was presented to the court, but as a result of a miscarriage of justice, the requirements of LLC “First Restaurant” were unjustifiably satisfied. At present, the court decision has not entered into legal force in connection with the filed appeal. Thus, LLC “First Restaurant” DOES NOT HAVE the right to file an application for declaring LLC “Trading House“ Baltic Coast ”bankrupt.
The actions are aimed at causing damage to the business reputation of TD “BALTIISKIY BEREG” LLC. According to the information posted on the “Arbitration file cabinet” website, LLC “Pervy restoran” is not the first to resort to a scheme for receiving cash, using the possibility of immediate execution of a judicial decision made in simplified proceedings, that is, before the judicial act comes into force.
Currently, work is underway to identify the persons involved in the commission of these actions against the company.
